These special terms and conditions of sale regulate the sale of custom products between the company Drum Stroke di Polvani Marco (hereinafter referred as “Drum Stroke”) and the Buyer (hereinafter referred as “Customer”), and are in addition to Drum Stroke's general terms and conditions of sale.

Hereinafter, the expression “graphic element” denotes any element that characterizes a graphic artwork, including (but not limited to): drawings, photos, fonts, logos. The expression “graphic design” denotes any work composed of one or more than one graphic elements. The expression “custom product” denotes any product made by DrumStroke specifically for the Customer or any product made by a third party and modified by DrumStroke specifically for the Customer.

a) DrumStroke is not responsible for the unauthorized use of graphic elements provided by the Customer and will not be liable for any violation of local laws or infringement of third-party rights resulting from the use of graphic elements provided by the Customer. The Customer exonerates DrumStroke from any responsibility towards third parties who should claim violations of their intellectual property rights, damage to their public image, honor, dignity, moral integrity or in any case any patrimonial and non-patrimonial damage suffered as a consequence of the production of graphic designs and/or products that include graphic elements provided by the Customer.

b) If the Customer commissions DrumStroke to make a product whose graphic design is equal to an existing graphic design, the Customer, under his own responsibility and aware of the legal consequences related to false statements, declares that he/she either has obtained the authorization to reproduce the graphic design, or that the graphic design is not covered by copyright, or that he/she detains the copyright of the graphic design. Therefore the Customer exonerates DrumStroke from any responsibility related to any possible violation of third-party rights existing on the graphic design or on parts of the graphic design.

c) If the Customer commissions DrumStroke to produce a graphic design similar to an existing graphic design, the Customer exonerates DrumStroke from any responsibility towards third parties who should claim violations of their intellectual property rights, damage to their public image, honor, dignity, moral integrity or in any case any patrimonial and non-patrimonial damage suffered as a consequence of the production of the graphic design and/or of products that include the graphic design.

d) Drum Stroke reserves the right to refuse to produce and/or represent graphic designs deemed controversial and/or illegal.

e) Drum Stroke does not accept requests to cancel and return purchases of custom products.
