The contract of sale between the company Drum Stroke di Polvani Marco (hereinafter referred as “DrumStroke”) and the Buyer (hereinafter referred as “Customer”) is treated in accordance with the Italian legislation in force (D.Lgs. 206/05).
The present general terms and conditions of sale are subject to change without notice. Any changes will be effective from the date they are published.

ACCEPTANCE
By placing an order through DrumStroke's website, the Customer declares that he/she has read, understood and entirely accepted the present general terms and conditions of sale.
The contract of sale between DrumStroke and the Customer is concluded when the order is submitted.
All transactions for purchases and refunds trough DrumStroke's website are carried out in the Euro currency exclusively.
In order to make purchases through DrumStroke's website, Customers must be 18 years or older at the time the order is placed.
The customer declares and guarantees that any information provided to DrumStroke during the registration to its website and in any other moment is accurate and truthful.
The communications between the Customer and DrumStroke are carried out in English or Italian language exclusively.
In case that DrumStroke is not capable to fulfill an order, in its entirety or partially, for any reason, the corresponding payed amount will be refunded to the Customer. In no case the Customer can claim any further compensation and DrumStroke cannot be considered responsible for any direct or indirect damages due to the non-fulfillment of an order.


HOW TO BUY
Each non-custom product listed in DrumStroke's website is presented with a description and/or with one or more images. The information reported is provided by the companies that market the product, and might be not exactly representative of the actual product. DrumStroke cannot be deemed responsible for differences between the information reported in its website and the actual characteristics of the non-custom articles on sale.
Custom products are developed according to the Customer's specifications. Once a custom product is defined, the Customer will receive the link to a page of DrumStroke's website with the description of the product and, in most cases, one or more previsualizations. Most custom products include parts that are made by third parties (for example, the drumheads on which custom graphic designs are applied). DrumStroke cannot be deemed responsible for differences between the information reported in its website and the actual characteristics of the parts made by third parties.
In addition to the present general terms and conditions of sale, custom products are subjected to special terms and conditions of sale for custom products.
In order to buy a product (both non-custom and custom), the Customer needs to access the website page where the product is listed, click “add to cart” and proceed to the check out.
All prices reported in the website are VAT included, unless otherwise specified.
When an order is received, DrumStroke sends a confirmation e-mail to the Customer's address. The confirmation e-mail includes date and time of order reception and the details of the purchase, along with the Customer's data. The Customer is required to verify the correctness of the data in the confirmation e-mail and to communicate any possible correction.
The turnaround times are reported in the specific section of the website. If, for any reason, the specified turnaround times should be exceeded, DrumStroke will promptly inform the Customer and provide an estimate of the actual waiting time. If the Customer decides to cancel the order of a product because of its increased waiting time, DrumStroke will refund the correspondent payed amount.

WARRANTY AND SUPPORT
The products sold by the DrumStroke are covered by warranty in accordance with the Italian legislation in force (D.Lgs. 206/05).
In order to claim warranty rights on a product, the product must be unused or have been used and maintained correctly. DrumStroke cannot be deemed responsible for damages, deterioration or malfunctions of a product that has not been used correctly for its intended use and/or not maintained properly.
If the delivered shipping contains damaged products, or if some ordered products are missing, or if some delivered products do not correspond to the ordered ones, the Customer must promptly inform DrumStroke.
The legal guarantee covers all products that have a lack of conformity, which is present at the moment of delivery and becomes apparent within 24 months from delivery of the goods (12 months for used products). The lack on conformity must be communicated to the seller within 2 months from the moment it is discovered.
There is a “ lack of conformity” when a purchased item:
- is not fit for the purposes for which goods of the same type are normally used;
- does not comply with the description given by the seller and does not possess the qualities of goods which the seller has held out to the consumer as a sample or model;
- does not show the quality and performance which are normal in goods of the same type and which the consumer can reasonably expect;
- is not fit for any particular purpose for which the consumer requires them and which he made known to the seller at the time of conclusion of the contract;
If a purchased item presents a lack of conformity, the buyer has the right to have it brought into conformity, free of charge, by repair or replacement.
The consumer may require an appropriate reduction of the price or have the contract rescinded in one of the following situations:
- repair or replacement are impossible or disproportionate;
- the seller has not repaired or replaced the item within a reasonable time;
- the replacement or repair carried out previously caused significant inconvenience to the consumer.
